1. About the Service
Apinator ("Service", "we", "us") is a free, open-source WebSocket infrastructure service operated as a personal hobby project by an individual based in Austria. The Service is provided to the public at no cost.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Nature of the Service
The Service is provided free of charge as a community resource. It is not a commercial product. There is no company or legal entity behind it — it is maintained by a single individual in their spare time alongside full-time employment.
3. No Guarantees
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:
- Availability or uptime of the Service
- Accuracy, reliability, or completeness of the Service
- Fitness for a particular purpose
- Uninterrupted or error-free operation
- Security or safety of data transmitted through the Service
We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, and without liability to you.
4. Limitation of Liability
To the fullest extent permitted by applicable law, the operator of the Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Service.
This includes, without limitation, damages arising from:

You use the Service entirely at your own risk. If you require guaranteed uptime, SLAs, or support, this Service is not suitable for your needs.

You agree not to use the Service to:
- Violate any applicable laws or regulations
- Transmit malicious code, spam, or harmful content
- Attempt to gain unauthorized access to the Service or its infrastructure
- Interfere with or disrupt the Service for other users
- Use the Service for any illegal or fraudulent purpose

We reserve the right to suspend or terminate your access if we reasonably believe you are violating these terms.
6. Accounts
You may need to create an account to use certain features. You are responsible for keeping your credentials secure. We are not liable for any loss resulting from unauthorized use of your account.
7. Intellectual Property
The Apinator platform is open-source software. The specific license terms for the source code are defined in the project's repository. The Apinator name, logo, and branding remain the property of the operator.
8. Third-Party Services
The Service may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services.
9. Donations
The Service may accept voluntary donations. Donations are non-refundable and do not entitle you to any additional rights, guarantees, support, or service levels beyond what is provided to all users.
10. Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top of this page indicates when the latest changes were made. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the courts in Austria.
